1. Scope and responsibility
This Acceptable Use Policy applies to all access to and use of Getracked networks, systems, IP addresses, colocation connections, virtual and dedicated servers, VPN, web hosting, accounts, and related services. It forms part of the Terms of Service and every service order.
Customers are responsible for activity originating from their services, including activity by users, administrators, applications, devices, contractors, and compromised accounts or systems. Customers must maintain reasonable security, keep contact information current, and promptly address abuse notices.
2. Unlawful, fraudulent, or harmful activity
You must not use a service to commit, facilitate, promote, or conceal activity that violates applicable law or the rights or safety of another person. Prohibited activity includes:
- fraud, impersonation, phishing, identity theft, extortion, or deceptive schemes;
- distribution, possession, or facilitation of child sexual abuse material or exploitation;
- credible threats, targeted harassment, stalking, or incitement of violence;
- trafficking in unlawful goods, stolen data, access credentials, or malicious services;
- circumventing sanctions, court orders, regulatory restrictions, or lawful investigations; and
- collecting, using, or disclosing personal information contrary to applicable privacy law.
3. Security and network abuse
Without clear authorization from the system owner, you must not:
- gain or attempt unauthorized access to an account, device, network, data, or service;
- scan, probe, test, exploit, or interfere with systems or security controls;
- introduce or distribute malware, ransomware, destructive code, botnets, or credential-stealing tools;
- launch or facilitate denial-of-service attacks, packet floods, amplification, spoofing, route hijacking, or similar disruption;
- operate an open proxy, open relay, public recursive DNS resolver, or other service commonly abused by third parties without effective access controls;
- forge headers, source addresses, routing information, or identifiers to conceal abuse; or
- interfere with monitoring, logging, rate limits, authentication, or other safeguards; or
- submit malicious code, injection payloads, automated abuse, or deceptive identity information through website forms or live chat.
Legitimate security research, penetration testing, and vulnerability scanning require prior written authorization covering the targets, methods, timing, source addresses, and contacts.
4. Email, messaging, and automated traffic
You must comply with Canada’s anti-spam legislation and other applicable messaging, telemarketing, privacy, and consumer-protection requirements. You must not:
- send unsolicited bulk or commercial messages without the required consent, identification, and unsubscribe mechanism;
- use purchased, harvested, or unlawfully obtained contact lists;
- send messages with deceptive subjects, sender information, domains, or unsubscribe processes;
- continue sending after a valid unsubscribe request or use Getracked to evade provider blocks; or
- promote or support services whose primary purpose is spam or messaging abuse.
5. Shared resources and service integrity
You must use resources within the limits of your service order and must not unreasonably degrade a shared platform or another customer’s service. Prohibited activity includes avoiding usage limits, monopolizing shared compute, storage, network, or address resources, operating unauthorized cryptocurrency mining, and causing excessive load after notice.
Customers must apply security updates, protect credentials and private keys, maintain appropriate backups, and configure hosted systems so they do not create a material risk to Getracked or others.
6. Content, intellectual property, and notices
You must have all rights and permissions needed for content, software, and data stored or transmitted through the services. You must not infringe copyright, trademark, privacy, publicity, confidentiality, or other rights.
Getracked may process valid legal notices, preservation requests, production orders, and Canadian copyright “notice-and-notice” communications as required by law. Forwarding a notice does not mean Getracked has determined that infringement occurred.
7. Investigation and enforcement
Getracked may investigate suspected violations and request information or corrective action. Depending on urgency, harm, history, and legal obligations, Getracked may filter traffic, isolate a system, remove or disable access to content, suspend or terminate a service, preserve evidence, charge reasonable remediation costs permitted by the agreement, or notify affected providers or authorities.
Where reasonable, Getracked will provide notice and an opportunity to correct a violation. Immediate action may be taken when necessary to protect people, systems, customers, network integrity, or legal compliance. Customers remain responsible for fees during a suspension caused by their violation unless applicable law requires otherwise.
8. Reporting abuse and appeals
Send reports through the support contact form with the subject “Abuse Report.” Include relevant IP addresses, URLs, timestamps with time zone, log excerpts, and contact information. Do not send passwords or unnecessary sensitive personal information.
A customer may ask for a review of an enforcement decision by replying to the notice with supporting facts and remediation steps. Getracked may update this policy as threats, services, and legal requirements change.
